Under no circumstances will we be liable for any loss howsoever caused incurred by you through the action or inaction of Katherine Maginnis Ltd in relation to these Terms & Conditions of Sale.
We may, from time to time, update or amend these Terms and Conditions of Sale, without notice to ensure compliance with the law or our business requirements.
These Conditions shall be governed by and in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the Courts of England.
Due to the individual nature of many of the items shown on the website the exact colour, size and composition of the art may vary slightly from the image and description given on the website.
We endeavour to ensure that prices quoted on the website are correct and that all products have been accurately described and illustrated. However, when ordering products through the website, please note that:
Dimensions shown on the website are for guidance only and should not be used in critical circumstances.
We take reasonable care to illustrate and describe our products accurately. The colours on the website may vary from monitor to monitor and your monitor may not accurately reflect the colour of the product on delivery.
All orders are subject to availability. If the product you have ordered is not available you will be informed immediately.
All goods are offered for sale subject to availability. Only when you receive an Order Confirmation email from us can an order be deemed accepted. Prior to the dispatch of the product, we maintain the right to decline or cancel an order for any reason.
If we cannot supply the product you ordered, we will not process your order. We will inform you of this via email and if required refund you in full as soon as reasonably possible.
If for any reason we are unable to fulfil your order, we will inform you as soon as possible. You acknowledge that we will not be liable for any loss in such circumstances.

Prices and Payment
All prices are in Pounds Sterling and inclusive of UK VAT (at the current rate) where applicable.
Purchases originating outside of the EU will have VAT (at the current rate) removed during the purchase process. The buyer shall be responsible for any other taxes other taxes applicable in the territory to which the goods are shipped.
As part of the website checkout process you will be asked to enter your payment details. All compulsory fields must be completed. By completing your payment details, you confirm that the credit or debit card being used is yours. We will not store any of the personal financial information you supply during checkout except for the purpose of processing your order.
Payment can be made via Credit/Debit Card or PayPal. All card payments are subject to authorisation by your card issuer. Payment in full is taken immediately.
All products ordered remain the property of Katherine Maginnis Ltd until full payment has been received and delivery has been made to address specified by you.
The place for delivery will be as shown on the Order Confirmation and the normal method of delivery (unless specifically agreed otherwise) shall be regular postage or courier at our discretion.
We will endeavour to process and ship an order within 7 days of Order Confirmation. Any dates quoted for delivery are indicative only. Katherine Maginnis Ltd will not be liable for any loss or expenses arising from any delay in the delivery of goods howsoever caused.
The goods leave our studio in perfect condition and are protected from damage during transport. The goods are insured against shipping damage and their condition is recorded before dispatch. Please check the packaging before opening and photograph any damage. Inspect the goods and where required sign the proof of delivery or collection acceptance document. Acceptance will constitute conclusive evidence of receipt of the goods free from any defect or damage. If the goods are alleged to be damaged or defective on delivery a description of the alleged damage or defect must be given in writing at the time of delivery. Katherine Maginnis Ltd will not be liable for any damage to goods caused any time after receipt. If you wrongfully fail to take delivery of the goods we shall not be liable.
If you decide to cancel your order prior to shipping please email firstname.lastname@example.org
We will cancel your order and fully refund your payment. Confirmation of cancellation will be emailed to you. Unfortunately, once an order has been shipped, cancellation is no longer available and the order must be treated as per our return/refund policy below.
You have the right to return goods within 14 days of receipt for an exchange or refund. Contact us at email@example.com with the details below:

We will contact you with instructions how to proceed.
Customers are liable for return delivery costs and required to use a traceable delivery service. The goods must be returned in the condition they arrived following the instructions provided.
Wrap the goods securely in the original packaging.
Send the package to the address supplied in the email.
We will notify you via e-mail when we have processed your return.
We will process and refund all returns within 30 days of receiving the returned goods. Refunds will be made to the payment card (or PayPal) used when placing the order and will exclude any delivery and card processing costs.
Please note your right to return products does not apply to bespoke goods made to your personalised specification. Our returns policy does not affect your statutory rights.
